A landmark ruling in a Kenyan case has seen the government ordered to issue a child born with ambiguous genitalia a birth certificate. The first of its kind, the case could be a step towards recognising intersex people in Kenya, remarked the child’s lawyer.
The child in question was born in 2009 but never received a birth certificate due the ambigious sex organs. The child could therefore not enjoy basic legal rights such as attending school.
“Now they are going to be able to get a birth certificate,” John Chigiti, the child’s lawyer.
The court case also ordered the Attorney General to name a body that will be tasked with conducting a census of intersex Kenyans and coming up with policies for their recognition and support.
